Can a client include approved but not received reserve for replacement releases from the lender in their year end surplus cash computation? I see it in the instructions for the surplus cash form and according to my client the mortgagor has told them they can include it. However, the version of the regulatory agreement in effect does not have that language as the regulatory agreements were signed prior to 2014. I am concerned the regulatory agreement trumps the most recent version of the form.

David, the COA for multifamily does list approved, but not paid R4R requests as specifically includable in the surplus cash calculation.  There will be no issues with including it if it was approved by HUD before year end.
