Hi Les,

Has HUD released an official position on pass through entity taxes? I assume it would be considered an use of surplus cash and presented as a non-entity expense on the statement of operations but couldn’t find anything from HUD to support this.

Jeremy, any tax, not related to the actual project will always be considered an entity expense. However, the real issue isn’t the pass-through, but the nature of the tax. There are states that have such taxes that are considered project-related. Those are generally defined as a tax of the project itself and not the project’s owners. That is the only burden of proof.
