I have a client that has asked a question about prevailing wage requirements.  It is a multifamily non-profit entity with a Section 202 Capital Advance and a PRAC subsidy.  The local County has an energy efficiency program under which the Project has been approved for the replacement of its boiler.  The program is funded with Federal weatherization funds.  The representative for the program has indicated that since the Project receives a Section 8 subsidy, the contractor installing the new boiler would be subject to prevailing wage requirements.  The managing agent had a boiler replaced in a different Project under the same County program and they didn’t require prevailing wages requirements to be followed at that time.  Could you point me to where I can find what requirements actually do apply?  The Project would be required to foot part of the bill and using a prevailing wage contractor might make the boiler replacement not affordable.

Neil, the challenge here is that the project does not get Section, but a PRAC. The 202 program does require Davis Bacon where Section 8 does not. I believe that the 202 compliance supplement indicates this. (14.157). At least we need to for construction and rehab. I included the section from the supplement below. It is unclear if a boiler replacement qualifies. This is just a repair not a rehab.

1. Wage Rate Requirements
Compliance Requirements All laborers and mechanics (other than volunteers under the conditions set out in 24 CFR part 70) employed by contractors and subcontractors in the construction (including rehabilitation) of housing with 12 or more units assisted under this program shall be paid wages at rates not less than those prevailing in the locality, as determined by the secretary of labor in accordance with the Wage Rate Requirements. A group home for persons with disabilities is not covered by these labor standards (24 CFR section 891.155(d)).
